General Terms and Conditions for the Online Ticket Shop of the State Capital Hanover

I. Scope of Application

By purchasing the admission ticket, contractual relations with regard to attending the event are established exclusively between the ticket holder ("Customer") and the State Capital Hanover (hereinafter "Organizer").

The following General Terms and Conditions ("GTC") of the Organizer apply to these legal relations. The Customer agrees to these GTC upon conclusion of the contract.

II. Conclusion of Contract

The offer to conclude a contract comes from the Customer as soon as they complete the ordering process by booking the desired online ticket(s). A contract between the Customer and the Organizer is concluded upon the Organizer's online confirmation to the Customer.

No guarantee is given for the accuracy of the data contained in the online presence.

The Organizer is entitled to cancel an order of the Customer that was confirmed online pursuant to Section II.1 (unilateral right of withdrawal) if the Customer violates specific conditions set by the Organizer, which were pointed out during the presale, or attempts to circumvent them (e.g., violation of the limit on the number of tickets per customer, bans on resale, attempts to circumvent restrictions by registering and using multiple user profiles, etc.). The declaration of cancellation/withdrawal may also be made implicitly by crediting amounts already paid.

For the purpose of traceability of possible chains of infection, for instance in the context of a pandemic, the collection of visitor data is mandatory. The full name of the ticket purchaser must be provided when ordering.

Every Customer must comply without restriction, during the event visit, with all orders of authorities for the prevention of danger, in particular those pursuant to the Infection Protection Act or regulations based on it, such as safety and hygiene concepts, including those issued by us or third parties. In the event of non-compliance, the Organizer reserves the right to exclude the Customer concerned from (further) attendance of the event.

III. Price Components and Payment Terms

The statutory value-added tax is included in the ticket price.

You can pay by credit card (VISA, MasterCard, American Express), by Klarna direct debit, or via PayPal. Payment processing for VISA and MasterCard is carried out by Kzemos Technologies S.L.U., Calle de Fernando el Santo 16, Madrid, Spain, via authorized payment processors.

Data transmission for credit card transactions using 3D Secure: Due to statutory requirements (implementation of the Payment Services Directive "PSD2") and/or to protect against fraudulent use of credit card data, the so-called 3D Secure procedure may be used. In this process, browser data, credit card data, address data (billing address, email address), and the transaction amount with currency are transmitted via the credit card organizations to the card-issuing institution. This data is used by the card-issuing institution to assess the fraud risk of the transaction; depending on the amount and the result of the credit institution's review, additional authorization of the credit card transaction, e.g., via TAN or app, may be required.

IV. Delivery of Online Tickets Purchased in the Online Ticket Shop

When online tickets are purchased in the Organizer's online ticket shop, the online tickets are generally delivered by sending a Print@Home or mobile ticket to an email address specified by the Customer during the purchase process.

This electronic delivery of online tickets is free of charge for the Customer.

V. Special Additional Services

If, in deviation from Section IV.1, the Customer requests during the purchase process the production, assembly, and shipment of a hard ticket (thermal or laser print on ticket blank) otherwise only available at stationary points of sale, additional fees are charged for this.

The amount of these fees depends on the number of tickets (weight of the shipment), the ticket category (single ticket or season ticket), the shipping method (postal mail, registered mail, small parcel, or express), and the need for transport insurance, and may vary by event. The fee is displayed in the shopping cart when these additional services are ordered. Beyond this, no further undisclosed costs arise.

If the booking is made only a few days before the respective event, the tickets will no longer be sent to you. If the Organizer offers the option of "deposit," the tickets will be held for you for personal collection at the event venue. Information on the location, date, and costs of the possible collection can be found in the details provided in the online ticket shop.

VI. No Consumer Right of Withdrawal

A right of withdrawal for consumers does not exist for distance contracts for the provision of services in the areas of accommodation for purposes other than residential, transport of goods, motor vehicle rental, delivery of food and beverages, and the provision of other services in connection with leisure activities, if the contract provides for a specific date or period for performance (Section 312g (2) sentence 1 no. 9 of the German Civil Code (BGB)); in particular, there is no right of withdrawal for event tickets. This means that, insofar as the Organizer offers services in the field of leisure events, in particular admission tickets for events, there is no right of withdrawal. Every order of admission tickets is therefore binding immediately upon confirmation by the Organizer and obligates the Customer to accept and pay for the ordered tickets.

VII. Limitations of Liability, Exclusion of Rescission for Certain Breaches of Duty

The Organizer is in any case liable without limitation under the Product Liability Act, for damages caused intentionally or through gross negligence, for fraudulent concealment of defects, and for damages resulting from injury to life, body, or health. Liability for damages arising from the breach of a guarantee is also unlimited.

In the event of a breach of essential contractual obligations (so-called cardinal obligations) that is based only on simple negligence, the Organizer is liable only up to the amount of the foreseeable damage typical for this type of contract.

Except in the cases mentioned in paragraphs 1 and 2, the Organizer is not liable for damages caused by simple negligence.

The Customer's right to withdraw from the contract due to a breach of duty for which the Organizer is not responsible and which does not consist of a defect in the goods is excluded.

Insofar as liability is excluded or limited under the preceding paragraphs, this also applies to the liability of vicarious agents and agents performing obligations on the Organizer's behalf.

VIII. Final Provisions

The law of the Federal Republic of Germany applies exclusively.

The sole place of performance for delivery, service, and payment is the State Capital Hanover, provided the Customer is a business within the meaning of Section 14 of the German Civil Code (BGB).

If the Customer is a merchant, the exclusive (also international) place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship is the State Capital Hanover. In the case of cross-border contracts, this also applies to non-merchants. The Organizer reserves the right to bring proceedings before any other internationally competent court as well.
